QUESTION

Am I being discriminated against?

Asked on May 10th, 2012 on Labor and Employment - Louisiana
More details to this question:
I feel as though I have been treated unfairly at work, but I am not sure if it's legally 'discrimination'. There seems to be a core group of employees that are afforded flexibilites and liberties that I am not. For instance, when my kids are sick, the owner makes me take it out of my vacation time when the other Sales Rep gets to work from home. The owner blatantly offers professional sports tickets to everyone but myself and one other female employee. My direct manager came in no earlier than 9:45 for 9 yrs and left early to accomodate her childrens' schedules. Last summer, when Summer Camp started for my 5 yr old son's first day, I came in a little late. Like 9:30. I went in and was telling my mgr about how it went and I reminded her that because of the drop-off practices at the camp, there may be days that I get in around 9:30 if I get stuck - same as the previous yr. She asked me to write her an email so the boss would know that I wasn't out shopping on those days but that it wasn't a problem. He came back stating 9:30 start = 5:30 finish, which was not possible for me to do. She said don't worry about it, she understood. Then the following day when I was working from home (scheduled WFH day) at close to 5pm, she sent me this long email about how 9:30 to 4:45 is not 40 hours and essentially that if I don't like it too bad. Then she pretty much told me I had to fill out a time card. I asked if anyone else had to and she said only I was changing my hours, which wasn't true. Nothing had changed at all. For 10 yrs now I've been arriving at work between 8:30 and 9:30 and start closing down my computer at 5:52 on the dot so I can make it to daycare. It was her schedule that changed, after 9 yrs she could get in by 9 and suddenly I became a problem employee. I said if I have a time card then I vote everyone has a time card and she said, there will be no vote and pretty much that if I want to make a stink about the owner was going to take away our

The facts of your question are very interesting. Sometimes meeting with an attorney and talking through these issues ends with a discovery that there is indeed some type of discrimination going on. Sometimes it is harder to see than more blatant and obvious types of discrimination. It may make sense for you to set a meeting with an attorney - some will offer free consultations like we do - and see what comes out of the meeting.
