QUESTION

Am I eligible for the 2014 annual incentive plan?

Asked on Jan 16th, 2015 on Labor and Employment - New Jersey
More details to this question:
I resigned from Air Canada on January 5, 2015 with 2 weeks notice. I was informed by upper management that I am not entitle to my 2014 Annual Incentive Plan though I completed and contributed in 2014. The requirement for payout is the employee must be employed with Air Canada during the payout period. I reviewed my Benefits for US Employees Management Offer letter and this criteria is not stated. I was advised this information is posted somewhere within the company's intranet site. Am I entitled to this bonus? This bonus is separate from the company's Profit Sharing Plan.

To properly answer the question, I would have to see the employment agreement. However, the  majority of contracts that I have reviewed, require that you be employed with the company on the bonuses are paid. For example, the majority of Wall Street firms require that you be employed on the day the bonus is paid.
