They are a member of a protected class only if they can prove that their being over 40 was the cause of the discrimination.

As to their proportion of the population, this is not a legal issue. And it is a nonsensical question. In what location? On he island of Guam? Downtown Santa Ana? What day of the week and where do you want to take the census? Their rights are as set forth in the laws and the Constitution, as are all persons' rights. You clearly are driving some point or other.
