QUESTION

Being filmed at work without permission

Asked on Jun 24th, 2014 on Labor and Employment - North Carolina
More details to this question:
I want to know if a supervisor has the right to secretly film you on the job site in the state of NC. My husband caught his supervisor hiding and filming him with his personal cell phone. He works on the rail yard doing railroad maintenance and has been complaining of an back ache so today while he was using a saw and doing some cutting (like he was suppose to be doing) he looked up and saw his boss filming him. I just want to know if this is legal or not.

Yes, it would be legal if it is just video.  It could violate the criminal law if the supervisor is recording audio of your husband in certain circumstances.
