I work for UPS protected by a contact and Union. I clocked out at 1718 on 11/15 at which point a manager requested I stay 30-45 minutes to fill in for local sort that started at 1800 until the driver that was supposed to be covering arrived. I told the manager my ride was on the way and I had to go of which he said I am instructing you to work local sort. I left at 1730. I was called into the office on 11/16 and was threatened with being terminated even though I was instructed to do a job after I had clocked out and had seen others leave. My center manager is now requiring me to stand up in our morning meeting in front of the other 90+ employees like me and give a heart felt speech about my disciplinary action received and why and is she doesnโt feel it is heart felt I am at risk for loosing my job. Is this legal?
I cannot answer the union question as that is labor law. You need to find out from your union or, if you are not happy with the union answer or do not trust the union, see if you can find a labor lawyer. Those lawyers are hard to find these days.
However, the employment law answer is clear. This is not a violation of any employment law and nothing would legally prohibit the employer from demanding that you stay over or prohibit her from making you stand up to give a speech.
