I worked for the company almost a year. Never called out, rarely late. I found a better job and quit Friday jan 31. My check was usually deposited through direct deposit but they were able to cancel it and issue me a paper check. When Friday came I called my former manager and asked her if I can pick up my check. She said yes and I made my way on the other side of town to pick it up. After I get there she tells me that I cannot get my check because the drawer was short $100 on my last night of work. I have to pay $100 cash in order to get my check. My rent was due and other bills and now I unable to pay those bills. Can they do this legally?
No, they cannot withhold your final paycheck. It seems like the most they should be able to do is to deduct the $100 that is in question, but even that is questionable. If you get a lawyer involved, they will probably hand it over rather than facing incurring legal fees.
