I got an estimate on my house for an insurance claim. The contractor that did the estimate met with the insurance adjuster. I got the check, and want to go with a different contractor. The adjuster said that I have the right to go with who I want. I told the first contractor that I was going with someone else and he said that we had a verbal contract and he could sue me for profits he would've made on the job. I never told him I wanted him to do the job. I only asked for the written hail damage report that the insurance requires. I think he is trying to scare me into keeping him.
If you do not say to him "I agree to have you do the work for "x" amount." Or words to that effect, and there is nothing in writing, you are fine. Even if you did say something like that, state statutes frequently forbid home improvement contracts unless they are in writing, though under those facts you would want to sit down with a lawyer and discuss it further.
