QUESTION

Can I get fired for refusing to put extra hours at work?

Asked on Oct 16th, 2012 on Labor and Employment - New Jersey
More details to this question:
Here is the situation. I have put a lot of over time for this company and recently our boss couldn't meet payroll so we got paid 4 days later. My boss asked me recently if I can stay after hours to work on something and i told her very politely that I couldn't. I am hearing rumors now that she wants to get someone else and fire me. Is this legal?. I have never had a problem with them, so all this situation is new to me.

did you get paid correctly for the overtime ? as for the requested 'after hours', what was the basis for the request ? how much notice were you given ? did you explain why you could not work ? if you are an 'employee at will' [no employment contract] and there is nothing in the 'employee manual' which addresses 'extra work', you can be terminated for 'no reason whatsoever'. i would work with the boss and do the extra hours.
