I was on a write up for being absent and tardy from doctors appointments for my disability. I have a really bad back. I also got my prescription on my last doctors appointment when working there. My prescription came up half missing about 5days later at work (I was working at a Bank). I ask the 3 people that I work with if they seen anyone by my desk. they all said "no". When asking the assistant manager she thought I was blaming her right away. I told my boss I was going to make a police report, because that would be the only way my doctor would give me more of my medication for the rest of the month. The assistant manager kept raising her voice and called me dumb, stupid, and retarded. I was calm until she called me names so I defended myself. Once defending myself she told me "don't be mad because you don't have your medication". To me when something comes up stolen from a bank and someone gets defensive that shows her being guilty and the cops should be called immediately from the higher staff. Also when she made that comment about me being mad I felt she was making fun of my disability. My boss sent me home for the week. When returning the following week, she said I was terminated for being absent from the doctors and the conflict with the assistant manager. However, I was terminated for the same reasons that other employee's repeatedly do on a day to day basis. The conflict was right in front of my boss and nothing was done. Also the assistant manager did not get in trouble, and she still works there. They're more things while working there that I believe are illegal but this concerns me more. Was I wrongfully terminated??
If your back injury is work-related, you need to file a claim for worker's compensation benefits that cover temporary disability benefits , ongoing medical treatment and a settlement for permanent disability and future medical care.
You can be terminated for any or no reason. If you were late, you could be terminated for that, especially since it is not related to a work-related injury. So no, you were not illegally terminated.
