I have a cosmetology class that is 3 hours long, we work standing up for all 3 periods. I needed to go to the restroom by the end of 3rd pd so I asked the teacher nicely... her response was "No, We don't have time to have a line going to the restroom ". So I walked away and went to my station, I stood there while everybody was still working .She then said "What are you waiting for?!" I told I’m waiting for the restroom, I need to go really bad. She started saying stuff about I had to wait. So I told her, "I have 3 periods in this classroom and I can't get a restroom break, I really need to go! "She said "Then Pee On Yourself! " I said, "No, I’m Going To The Restroom Right Now" I walked out of class to go use the restroom which was right next to the class, I came back and she said "We're going to the office, pack your things "So I was going to put up my stuff and she said "No Come On! " I told her " I'm going to put my stuff up first "So she called the principal and of course he took her side and gave me a day of detention.
I do not know anything about school law, so I am unable to answer this question. If this is a public school, I suggest you report this to the Board of Education
I guess you can. your claim will be small and I doubt you will be able to afford to pay the cost, and I don't think any lawyer would take such a case on a percentage. But, yes, you can sue her. There might be a better way to handle the problem. Whose school is this? Does the owner know what is going on?
If you need to go to the bathroom, then as an adult, you tell the teacher that is where you are going. Go, do what you have to, and return. What happens if you wet yourself? That is ridiculous.
My first question to you is: are you a minor? If you are not a minor, you do not have to accept the teacher's denial of the right to use the rest room. If you are a minor, you can certainly make a complaint against the school teacher and the principal for not letting the students use the restrooms. The law is quite clear that accommodations must be made for religion, disability, feminine needs, etc. If you are denied this right to use the restroom, it will give rise to a complaint at the least and may be a law suit for abuse fo a minor.
