background check was provided to a company offering me a job. I was contacted by HR of hiring company and told we can no longer continue with the application process because background check came back negative. also stated I could re-apply listing my correct criminal record, if I wanted to. I told HR that was incorrect information and asked for background company name and phone number. this company reported I was arrested, convicted and served time in jail for possessing schedule 1-5 drugs. mind you the position I had accepted is in medical office that handles medications regularly. background co treated me like I was lying, never returning my calls, ect. I had to do my own research to prove my innocence. finally after 5days they apologized and said they reported incorrect info and contacted hiring co and re-sent corrected background check
If the company that sent the false information actually caused you to lose the position, you can and should file suit against them. If you eventually did get your job with that company, then it may not make financial sense to sue them. You should still see an attorney and perhaps negotiate a settlment for the aggravation, time and expense this all caused.
