QUESTION

Can I sue my work for not providing stools to sit on?

Asked on Oct 10th, 2015 on Labor and Employment - Illinois
More details to this question:
I started working at a gym and it's great and all but I recently had surgery in May on my knee and my knee starts to become stiff and hurt a little from all the standing I do at the front desk. From what I've heard, they have chairs at other gyms and I was wondering if they refuse to get chairs at my facility, especially with my recent surgery, would I be able to file a lawsuit?

If your knee condition and your need to sit will be ongoing for at least 6 months, then you may have a claim under the Americans with Disabilities Act for failure to accommodate.  You should have your doctor write a note explaining the need to sit for brief periods of time due to your knee condition.  Unless there is a very good reason for the employer to deny this, I would anticipate that it would be granted.
