Can my boss hack into my personal cell phone?

More details to this question:
I found out she hacked into my personal cell phone and deleted all text messages she had sent me concerning a legal issue. Everything I responded to her with is still there but all her texts have disappeared.

There is no employment law that prohibits this unless you work for a governmental agency. This might be a criminal matter though.
