QUESTION

Can my employer do this?

Asked on Apr 24th, 2014 on Employment Contracts - California
More details to this question:
I sent this email to Wyndham hotels "I recently applied at one of your motels in California and was interviewed and hired as a desk clerk/motel management position. I thanked my new boss and expressed how grateful i was for him hiring me. I then went and spent over $200 on clothing appropriate for the position. My first night on the job immediately I was sent home by a woman working the front desk for no reason, but told to come back the following night. I then received a message asking me not to come in at all because "they found someone else". I am appalled at my treatment and am looking into what I can do legally. I would appreciate a response from you HR staff please. Charles M. I don't do drugs and was wearing a long sleeve dress shirt. Is that slander? Telling the pubic that?

You probably have no recourse for losing the job.  Absent a contract which limits the employer's right to fire you (e.e.g. "employee can only be terminated for good cause"), or being fired for some reason prohibited by statute (e.g. race, religion, gender), your employer can fire you at any time and for any reason. However, you may have a good claim for slander.  While you probably sustained no actual damage from the employer telling your friend that you had track marks, this type of defamation may be considered "slander per se", which means that you would not have to prove actual damages to state a claim.
