Can my employer take my tips.

More details to this question:
I work in a resturant as a server and I'm a tipped employee. Recently my employer has been taking 35% of my tips and refusing to tell me where my money goes. Myself and other servers are punished for asking questions. I believe a portion of my money is going to a wine sommelier who already receives wages well over minimum wage. Another portion goes to "The House". I'm assuming that would be the owner of the resturant. My employer won't tell me where the remaining % is going. I believe this is in violation of the FLSA. Should I contact the Department Of Labor?
