Can past unpaid overtime be put through payroll?

More details to this question:
I have told the people I work for how much they owe me in unpaid overtime (Did not want to file a claim on them.) It is all overtime in the past (I know I can only go back three months.) My question is, can they legally put this through payroll now and have it taxed? Thanks in advance.

In Wisconsin, you can go back 2 years. Contact the Equal Rights Division/Wage & Hour Section.

Legally, the employer may pay you anything they wish. Unlimited, in their discretion. I am not aware of any 3 month rule, and do not believe such rule exist I suggest you go on line to Wage and Hour Division (WHD) U.S. Department of Labor http://www.wagehour.dol.gov/. They have investigators that answer such questions.

If an employer owes you wages there's no problem in processing it through the normal payroll system.
