QUESTION

Can you be terminated while pregnant because not eligible for FMLA?

Asked on May 18th, 2012 on Labor and Employment - Pennsylvania
More details to this question:
I started my job October 3o, 2o11. I became pregnant in January 2012 and notified my work the beginning of February. I knew FMLA would not kick in so I signed up for short term disability so I would have an income during maternity leave. I was told today, May 18th that once I leave to have my child that I will terminated because FMLA does not kick in and it is a "federal" issue and they have no choice. Terminating me also means I lose my insurance. Is this legal?

This is a general response. It is not legal advice. This is not a simple issue and is based on individual circumstances. It would be best to contact the Equal Employment Opportunity Commission to or check their website if you have access to a computer. The Pregnancy Discrimination Act should also be researched. If your employer has 15 or more employees and treats all medical conditions similarly, you should be able to keep your job if you are pregnant and after you return while on short term disability.
