Cell Phone Texts used for Work

More details to this question:
Previous employer provided a company-owned cell phone. Upon termination, they obtained the phone. Are they allowed to peruse the text messages on the phone and use them as evidence in a legal proceeding? If I feel I was wrongly terminated and file suit, can they present any texts and conversations I had with other individuals in court as long as the texts were not illegal?

Yes, they can read any messages on the phone.  Yes, they can use any of those messages in a legal proceeding.
