QUESTION

Defamation per se

Asked on Nov 18th, 2019 on Labor and Employment - New Jersey
More details to this question:
I’m an RN in NJ and work for the fed gov. I’ve had an EEOC complaint against a manager that’s accepted and awaiting a hearing. In the meantime a co-worker made false allegations against me (no evidence) I have phone records from his harassing texts. The manager and her boss used these allegations to get me reassigned put under investigation and now fighting a 3 day proposed suspension. All retaliation that I also filed with EEOC. My health has been compromised from the stress and I was on FMLA. I want to know if I have grounds for a defamation per se against this coworkers false allegations ? Ew

You are in a difficult position. You have a legitimate claim and now you must fight another battle at the same time with the same employer. You must proceed with you claim if you want redress. You must also address the allegations against you. I would focus upon the two litigations and not begin a third litigation regarding defamation. Defamation cases are expensive to litigate and difficult to prove. Ed Dimon, Esq. 732-797-1600
