QUESTION

Do I fall under contract labor?

Asked on Sep 18th, 2014 on Labor and Employment - Texas
More details to this question:
If I am hired as contract labor, and my boss dictates what time I start the day and end the day and is paying by the hour, is that "Contract Labor"? I get paid once a week and by the hour. My job is regulated on when she wants me to work and not work. Lunch time is deducted as well.

The IRS has an 18 point test to determine who is contract labor and who isn't. It's decided on a case-by-case basis, with the presumption typically that a worker is an employee and not a contractor unless proven otherwise.
