I was recently harassed and sexually harassed by my Supervisor during my 3 months stay on the job. I emailed his boss explaining about the harassment but wanted to speak to him about the sexual harassment. I got no reply so I went to my HR. I wrote a detail report about what happened to me. I also went to see a lawyer that was given legal advice. The lawyer said that I do have a substantiated claim if I choose to proceed. I told him that I would wait until HR did their investigation. Today I was called into the HR office. They told me that although that can't conclude that anything happened to me they didn't find anyone that collaborated my story. So, they couldn't do anything further and ask my if I wanted to go back to my old position working with my Supervisor or be transferred in another department. I felt violated twice, once by my supervisor and now my employer. I was sexually assaulted a year ago by a Superintendent of an apartment I went to look. I made a police report.
Truly sorry you are dealing with this. Whether you have a case depends upon many things: what happened, how many times the harassment happened, what was your title, what was the harasser's title, whether or not HR did an adequate investigation, whether the harasser has done this before to you or others, whether there is audio, video or email evidence of the harassment, whether the company you work for has insurance to cover these types of situations. In the end, a strongly worded demand letter from an attorney might encourage the company's insurance carrier and the company to pay you out to make this case go away. Feel free to call me at 929-262-1101 to discuss further as I can help you with that demand letter if it makes sense to send it.
