My employer terminated based on hear say. However, I received notice from a coworker that I was "dismissed" from all my duties on Aug 13, on Aug 14, I met with HR, informed them that I would not resign and was told the matter would be investigated. For 2 weeks, I never heard back from my employer. I received notice that my insurance had been cancalled. When I called to find out how, I was informed that I "resigned" on Aug 14. The same day I asked how, I received a call from HR to set up a meeting. On Aug 29, I received a letter informing me of my termination effective on Aug 25th. Is this legal? Is it legal for one to cut off your insurance and falsely state that you resigned?
There is nothing legally wrong with the employer saying to you that you resigned. Additionally, there is nothing legally wrong with the employer terminating your insurance once your employment has been terminated (whether by firing or resignation). The really question is whether you were terminated for an unlawful reason. You should set a consultation with an experienced employment attorney to discuss this matter if you believe it is something you wish to pursue.
