After being terminated with a mental illness, it wasn't until after the 300 allotted days, that i realized I could file with the EEOC, I did, and EEOC accepted my late filing, dismissed it, sent out letters of right to sue. Now I have received a letter from the EEOC stating there part is over but I still have the right to sue within 90 days of receipt of letter(even with late filing). If this is true, can you help? Thank You
The EEOC will always issue you a Right to Sue letter regardless of whether you have a good case, or if you filed your case late. This means that if your original EEOC was filed late, then you will not be able to prevail in court. If, however, your mental illness prevented you from filing on time, this is sometimes used as an argument to extend the time to file. This is not easy to argue. You would need to meet with an attorney to review your case in more detail
