QUESTION

Does my state require payout of vacation?

Asked on Jun 17th, 2015 on Labor and Employment - Georgia
More details to this question:
I was recently let go from a company. They tell me I will not be paid out for my vacation and that the handbook states as such. The strange part is I live in one state NC and work for a company HQ in another. I looked at the handbook and is reads: Payout at Termination: Accrued vacation time/Paid Time Off (PTO) cannot be used to extend employment. Unused accrued vacation time/PTO is paid out upon termination when required by state or local law. Neither floating holidays nor unused sick days are paid out upon termination, unless required by state or local law. Company reserves the right to withhold the final pay as pre-approved by the employee in writing, to satisfy any outstanding financial obligation incurred by the employee, including but not limited to vacation/PTO days paid in advance and cell phone expenses, unless prohibited by federal and state laws. Should I get paid?

You failed to state in which state you were employed. It varies from state to state, so no one can answer your question unless you identify the state. Note that the rule reads: Unused accrued vacation time/PTO is paid out upon termination when required by state or local law. This implies that it will not be paid to you, unless you worked in a state that requires such payments. Many employers do not pay this, you forfeit it when you leave the company. Many states do not require this payment.
