QUESTION

Does Texas require day off for people working 60plus hours?

Asked on Jul 01st, 2018 on Labor and Employment - Texas
More details to this question:
My brother works in ac repair for residential property topically in outside and in attics. He has suffered a heat stroke where he lost control of his body functions. His job has made him work normal hours and on call hours for about a month. He asked for a day off to recover in which they said he would be fired. Heat index is currently 103-107. He is working to death is there anything he can do? He just needs time off.

Typically, Texas employers are not required to give any days off and can require employees to work any number of hours.  Most employers are, however, required to pay overtime after 40 hours each week.  My understanding from my own clients is that AC folks are very much in demand, particularly this time of year.  In that one's health is usually regarded as more important than one's job, perhaps it would be advisable to find a new employer rather than attempt to fight with the current employer.
