QUESTION

Employee vs. Subcontractor Issues

Asked on Jun 04th, 2015 on Labor and Employment - Ohio
More details to this question:
I work 40+ hours for a landscape/mowing company that pays hourly with no overtime pay or any other type of benefit. The company claims everyone is a subcontractor but all the inform from the internet says we are employees. Now the company wants everyone to fill out a W-9 form and date it back to 1/1/2015. Do I need to fill out any paperwork and if I do, which ones? What rights do I have that I am not an employee nor a subcontractor??

Contact an employment attorney. Your rights are probably being violated by them not paying overtime and treating you as an independent contractor instead of as an employee. For example, you should be receiving overtime pay for all hours worked over 40 each week. As a result of the failure to pay overtime, you should receive your unpaid overtime wages, additional damages, and attorney's fees.
