QUESTION

Employer errors

Asked on Nov 14th, 2012 on Employment Contracts - Georgia
More details to this question:
I work for a Georgia state agency. There was a conversion to an online data processing 3 years ago to handle benefits and time. Last week I was informed that I had been accruing more sick and annual leave than entitled. This institution is now wanting to take back what I erroneously accrued. I am not responsible for entering any information into this system except for changes in demographics or montly leave time taken. I want to know if I can get them to not take this back all at once. I received an answer to the above question, but would it make any difference if I had inquired about my accrual a year ago? I had a coworker go through the same issue, and worried, I called my HR department and asked them to verify that I was accruing correctly. They stated that the current rate of accrual was correct. Myself and another employee did this last year.

Again, your employer has a duty to provide you only with the leave to which you were entitled and to correct its records upon learning of its error. An oral statement by your employer regarding the accuracy of its records does not make them accurate if they were, in fact, inaccurate.
