More details to this question:
I'm a bit of a disgruntled ex employee. I use to work for a company where I think I was unfairly treated. I made a mistake with posting a picture of me and a vendor on fb with no caption, no description or tags. Due to that I was not only reprimanded but also ostracized from my functional team and forced to side in the other side of the office by myself. To make matter worse my senior director out someone else in my cube to I guess show her power and put me in my place. I have no performance issues and in fact was praised as an asset to the company. I held level position in the company. I work in pharma and work 80/hr a week and work with development.

we are seeing more employers using 'mistakes' on the internet as a reason to  for  for 'downgrading' or 'dismissing' the employee. nj is an 'at-will' employment state so no reason has to be given. however, the 'mistake' you made regarding the internet gives the employer 'cover' to take actions, including dismissal, against you.  please let me know if we can help. ed dimon, esq.
