Equal Pay for equal work?

Asked on Dec 10th, 2012 on Employment Contracts - California
More details to this question:
I've been working here for 5 years. Last year I received a raise and promotion to Vice President. A new gentleman has begun working and he is getting paid the same amount as I am right now plus commission once he hits a certain amount of sales. I have never been never offered commission. The gentleman has declined our health insurance, but not dental. He also gets 2 weeks paid vacation while I receive 10 days, plus 6 sick days.

No law requires equal pay for every employee performing the same job function. If the pay differential is the product of discrimination on a basis precluded by law, you may have a claim -- but you do not set forth any such facts.
