QUESTION

False hiring position

Asked on Dec 16th, 2014 on Labor and Employment - North Carolina
More details to this question:
CDL Truck diving position. I was told I was being hired for a dedicated delivery route. After 3 months with the company Im being ignored by the safety dept and the head of operations. They refuse to acknowledge I have been put on odd jobs and now no compliance from the heads of the company to give me a yes or no the job position for which I was told I was being hired for, weather it actually is or is not becoming available. I passed up a hiring opportunity with another company to stay with this one. Also I was to receive a sign on bonus on 12-8-14 which I have not received! Im over their 90 day evaluation with only one day being off, the day after Thanksgiving. No one in this company will acknowledge my disgruntlement. I am becoming ignored buy my immediate supervisor to the issues and feel they are pushing me into quitting to be rid of me. I have recorded phone conversations of the hiring operations manager complying with the issue and proof they are ignoring me.

Unfortunately, there is likely nothing that you can do regarding the change in the duties from what you expected.  North Carolina is an employment-at-will state and the employer can change your duties or even fire you for any reason at any time.   They are not required by law to give you an evaluation and, if they are not giving the evaluation, then there is no way to force them to do so.  If your sign on bonus is in writing and it clearly says you are entitled to the pay and the date for payment, you may have a claim for unpaid wages.
