QUESTION

Former employer giving bad reference

Asked on Sep 19th, 2014 on Labor and Employment - Texas
More details to this question:
My wife worked for a doctor for 10 Yrs in Springtown Tx. He recently started giving my wife bad references. He contacted her present employer and told them she was a good employee for the first few years and after that she missed a lot of work, which is false. My wife did not even list the Dr as a reference but he contacted them on his own. My wife was friends with the doctors wife and he is taking action against her because he is going through a divorce. Is there any action my wife can take against the Dr.?

Your wife may have a civil claim against her former employer for defamation and tortious interference with contract.   However she will have to prove how she has been damaged by these communications.  Your question does not state whether she suffered any negative consequences at her new job as a result of her former employer contacting her new employer. In the event she is interested in pursuing these claims should contact an attorney to see if she has a case. Good luck.
