high school student suspension

More details to this question:
during lunch time high school friends are joking around, the boy pat a girls buttlock once, the girl simlely tell the boy to stop, the boy though the girl is kidding because the girl is not serious, the boy pat hardly on the girls butt another time. the girl started to cry, boy appolize to the girl, the girl reported to principal, boy get suspension and defined as sexual assault. the girl may realize they are friends and they are joking, she should not report to school so next day she went to principal's office and wanted the school to withdraw the suspension but school do not agree. boy is not charged only suspension, but will affect his college application.

the school has an obligation to record the student's 'complaint'. the school  has an obligation to act upon the complaint. the school may or may not take into consideration the female student having the opinion that the school should not suspend the male student.  her opinion would not be dispositive unless she said that the complaint was a fabrication.  ed dimon, esq.
