QUESTION

Hourly pay rate cut without notification

Asked on Dec 16th, 2016 on Labor and Employment - North Carolina
More details to this question:
Hourly pay rate was cut without written or verbal notification as well as over $300 taken from paycheck for "retroactive pay" without written notification. The hours cover the last 2 week period. Is this legal in the state of North Carolina? From what I am finding through the Department of Labor, it is not. If so, we would like to get some advice on what to pursue and how to start a case. Thank you.

Both actions would be unlawful under North Carolina's Wage and Hour law.  Pay reductions, while allowed, must be provided in writing to the employee and can only effect future wages.  You can file a claim with the North Carolina Department of Labor's Wage and Hour Bureau.  You can also file your own lawsuit.  The problem with filing a lawsuit is that you will need to pay court costs and an attorney and the case may not be worth purusing for a few hundred dollars (or even a couple thousand).
