I worked for Duke Energy and got sick due to unsanitary conditions. I was out one day and started getting threatening phone calls from my supervisor. She wanted to fire me for being out one day. She left messages on my phone and on my husband's line. I called HR and reported the harassment immediately. I was originally out sick for a week then was instructed to take a Leave Of Absence to protect my job. My doctor approved a LOA to allow me time to get better. My LOA does not expire until 4/21/14 but I was terminated as of 4/14/2014. I have not received the money due to me from my approved LOA and vacation time. I was told everything was sent to my then supervisor back on 3/12/14 and HR confirmed on 4/4/14. I have not gotten better and I feel Duke Energy should be held responsible for what has happened to me. I have nonstop pain and discomfort in my stomach from a stomach virus that was spread around the building in Jan. 2014. I have to take medication to try to calm the pain. Help me!
It is possible that the Family and Medical Leave Act (FMLA) could apply to your situation. If you were an eligible employee, working for an eligible employer, you are entitled to up to 12 weeks of leave per year to deal with a serious health condition. The employer must place you in the same or substantially similar position if you are able to return before the expiration of your leave. It is highly unlikely that you will be able to claim damages because you got a stomach virus at work.
