How do I stop an employee from creating a toxic work environment?

My wife's employer will not terminate an employee who has created a toxic work environment for many years. Several employees have either transferred locations, or quit, because of this employee. The employer is very aware of this, but will not fire her because she has been there too long. This employee has broken multiple work policies and even committed HIPPA violations. This environment has forced my wife to start taking medication, and it is now starting to effect our family. This is just a short summery, of the issues, from this employee.

Most employment is at will which means that an employee can be hired, promoted, or fired for good cause, bad cause, or no cause at all.  Absent statutory protection for certain classes of people against discrimination, an employer is free to act as he she or it wishes and the employee is free to quit at any time.
