My last employer owes me 63 hours at a rate of $10/hour. I worked as a caregiver for a Health Agency owned by one man, and this was also a limited liabitliy company, and I beleive he had under 10 employees. I have proof in pictures of reports I sent the clients family of the nights I worked, Picture of text messages of him saying his payroll crashed for one of the pay periods and asking how many hours I worked, as well as him claiming my check had already been cashed and he was going to look into it. I have proof of the work I did, but no paystubs to show for it.
Contact an employment attorney or the Ohio Department of Commerce's Wage and Hour Division. Your employer has 30 days from the regularly scheduled payday to pay you the wages you are owed before it violates the Prompt Pay Act. However, in addition to not timely paying you the wages you are owed, you also have not been paid at least minimum wage which violates another law. Feel free to contact my office if you would like representation.
