They were my client for 9 years and I was a part time employee for about five years before that. They contracted me to handle complI cared logistics that are very unique to this type of work. I worked all year long but contracted staff for a certain number of days each season and trained them in this unique work. My client basically fired me. All of my employees who were independent contractors for my company were immediately hired by my client. It's been about four years now, but I just found out they were employed by my client and doing the specific tasks I trained them for. I had all my staff sign non competes. Can you please advise me in general terms if I have any recourse?
The only claims that seem possible would be contract claims. If the franchise's actions violated the contract, then you might have a claim against the franchise for violation of the contract. Additionally, if the worker's violated their non-competes by going to work for the franchise, then there could be an action against the workers. However, even with clear written contracts and blatant violation, you may have a problem with statute of limitations on either action.
