Asked on Feb 12th, 2014 on Labor and Employment - Wisconsin
More details to this question:
I was hired and completed every step of the employment process except for schedule. I answered no to the question and I have a DUI misdemeanor from 2007 I thought minor and misdemeanor where the same. Have you ever been convicted of a felony or misdemeanor other than minor traffic violations? I thought because it was a misdemeanor it was minor can you help me clarify or did the school discriminate after I got hired when they said they are an EEO or is that legal.

I believe this is discrimination, but not illegal discrimination. Not all discrimination is illegal.

In Idaho, a DUI is a misdemeanor and it is not a minor traffic violation. And even if it were minor, it is not discrimination because it was not on the basis of your skin color, race, etc. You can be terminated for any or no reason unless it is because you are a member of a protected class. Now if the school is a governmental agency, you might have a right to due process. It may not overturn the termination, but it may give you an ability to explain yourself.

You are not clear how you were discriminated against by your employer. Were you terminated? Contact an attorney or the Wisconsin Equal Rights Division.
