QUESTION

Is my employment contract enforceable?

Asked on Feb 11th, 2014 on Labor and Employment - Georgia
More details to this question:
I'm thinking about changing jobs and I am curious if the employment contract with my current employer is enforceable. The employer's handbook states that no contract is enforceable unless signed by the company President/CEO. I signed my contract when I started but in the 10 months since, I have never been notified or provided a copy of the contract that is signed by the President/CEO even though there is a spot for that signature. What, if any, repercussions does this have? Is this contract enforceable if I quit?

Chances are if you are going to work for a competitor or are going to compete with your employer, you will find that the agreement has been signed. Also, it may be that the agreement is signed and in your personnel file. But unless you are going to compete with your employer, the agreement probably shouldn't have any affect on you.

No attorney can answer your question without reading the contract. If you are only asking about their signature, they may sign it any time, it may be already signed.
