My immediate supervisor and his boss told me I could take some scrap metal when I did I was accused of stealing and put on suspension nothing at all was done to the other 2employees.they werent punished at all they didn't even miss one hour of work.I haven't worked since 12/06/12my boss text me and told me I'm not terminated but I have been taken off schedule and not contacted since 1/1/2013
It is not necessarily against the law to punish employees unequally. If, however, the reason why you were punished and the others were not was based on discrimination (race, religion, national origin, etc.) or retaliation for certain types of activities (e.g., union participation, whistleblowing complaints, etc.) then the disparate discipline would be evidence of discrimiation or retaliation. This would allow you to file a lawsuit. You should speak to an attorney to explore this more
