My job was eliminated as executive VP of a division. I have been kept on staff at this time because I am 4 months away from having 30 years and getting a pension. If they were to eliminate this position I would take a 12 percent penalty on my lump sum because i am under 55. The magic number is 30 years. Now, I am getting a tremendous amount of pressure but I have little to no responsibility. I sense they are close to possibly eliminating this position. Do I have any legal ground here since I am 4 months from getting the full retirement package?
No claim simply because you are so close to retirement. However, if your job was eliminated for unlawful reason such as age discrimination, then you may have a claim on that basis.
