I went out on medical leave from Delta Airlines in July '12. They paid me disability for the first few months but, stopped once I started receiving disability from Social Security. There reasoning is that I "shouldn't be paid double and what I receive and half of the amount of what my kids make is equal to what they would be paying ". Is this legal?
The answer can only be found by reading the terms of the disability plan itself. I would not be surprised if the plan allows the company to do what it has done. But I don't know. You would have to ask the company for the portion of the plan that governs this.'
