Managers receiving tips.

More details to this question:
I work at a bar that claims to have a need to fill shift. Said shifts are filled with managers who are scheduled as salaried/management on the schedule. These managers all take tips even though they are clocked in as managers and receive salary pay. They do not need to be working these shifts there are plenty of employees asking for more shifts. Come to find out they have a deal with the owner to be able to work these shifts and collect the tips in order to compensate some income. This has been going on for about 3 years now. Not only are they taking tips but they are t erribke bartenders and no one likes to work with them. But that's besides the point. Are they allowed to take tips? A restaurant across the street was just sued for similar issues and I was thinking about contacting that same attorney. Is it worth looking into? Oh and the other person receiving tips is the general manager of the whole company.
