QUESTION

My issues are actually worker''s compensation, wrongful termination and Harassment/Discrimination.

More details to this question:
I was out on worker''s comp leave, my position was threaten, so my doctor released me to return to work (light duty). The Administrator in charge said I could not work light duty (I was a secretary) and made me punch out and go home. I got my doctor to release me against his orders to return to work full duty and I was still sent home (stating they needed something from downtown allowing me back). Weeks later (after following up sever times) I get an email from downtown stating my position had been vacated because of AWOL and that I was free to seek other employment within the district. I finished my treatment and was later released back to work. I found and was offered other positions within the district; however, when I went through the new hire process was told I could not be rehired because of my background (which was already cleared upon original hire and through a district wide background audit of all employees). I have the written docs to prove this.

It appears from the facts that you were terminated in retaliation for suffering a workers compensation injury.  This would be retaliatory discharge and legal action could be taken.  You should meet with an attorney to review your facts in more detail
