I signed a non-compete agreement when I was hired. I was promoted to a new position in July and had to sign a new non-compete. My question is "are these both enforcable?" or does the new non-compete nullify the old. The reason this is important is the old one listed the correct geographic area and the new one was never changed and lusted a geographic area more than 1000 miles away. I am looking to change to a new employer and need to know if I am bound to the original non-compete
Non-compete agreements are contracts so it depends on what the four corners of the document says. There may be a clause that says the new non-compete supersedes the old one.
