non compete-consulting

More details to this question:
during divorce my husband sold our business which i was not involved in. money was paid up front with a non-compete and consulting clause was written in for 9 years length of time . he is working 6-20 hours a week. receiving money monthy not having ss or taxes taken out. I feel this money is actually the balance of the sale price of the business covered up under the noncompete and consulting clause so he doesn't have to split half with me. thoughts?
