QUESTION

Non Competes enforcement in New Jersey

Asked on Apr 27th, 2015 on Labor and Employment - New Jersey
More details to this question:
Hi, I signed a non compete agreement with a IT consultancy firm based of New jersey which placed me in a bank as a contractor through a sub vendor and prime vendor. I'm offered full time position by the bank after 20 months of my service. The consulting firm is threatening to sue me for 60K based on non compete(agreement is very generic without specific details, it says I cannot work for its competitors). The bank I'm working for and consulting firm do not have any contract signed. The non compete is basically shared in a word document that I printed ,signed and shared in a email. I do not have the copy with other parties sign. Is this valid in court of law? Can he really sue me? Please advise. Thanks in advance for your time and help.

The New Jersey courts do not favor non-compete agreements.  Non-compete agreement will not be enforced unless there are special circumstances. We would need to review the noncompete agreement and terms and conditions of your employKent.  We can then advise you with regard to the presence of special circumstances and the ability of the employer to have the noncompete agreement enforced. Please email the noncompete agreement. Please email the circumstances surrounding your employment. We will review imm please email the noncompete agreement. Please email the circumstances surrounding your employment. We will review asap. Ed Dimon
