offered severance letter w/ releasedate

More details to this question:
we merged with a new company 12/2012 was given a severance letter with a estimated release date of 12/31/2013 with no explanation of options... did I have the option to take it then or not? now they decided to keep me permanent position with a demotion after 24 years..they have put me waiting for two years thru hell and back . I want to leave and walk with my severance how do I do this without losing my severance. after 2 years they now wanted me to filled for fmla i have a disabled child and need the flexability, going from a managers role to a telemarketer a demotion in my position.

The key is negotiating a settlement with your employer. You have multiple issues. I would not spend money on litigation at this point. I would first start with negotiations with the employer to see if there might be a middle ground that makes sense for both the employer and employee. There are merits to both sides of the argument. You had the settlement offer in 2012. You have the FMLA issue. The employer has the two-year passage of time and the ability to outspend you.
