My wife started working for Maxim home health. In her contract it says for on call hours, she is entitled to minimum wage for all hours worked. She works an 8 hour day normally. On every other weekend and Monday nights, she must take a cell phone home to answer calls from patients and from nurses from 4:30 pm when she leaves work, until 8am when she returns to work. She answers an average of 100 calls minimum and must log them at all hours of the night, sometimes 4am. After being on call an entire weekend, answering calls and looking up information, doing logs, her compensation totals to about 4 dollars. My question is, how is this legal? It not only restricts her time, it makes me lose sleep as well. How can someone only be paid $4 after countless writing logs, calls, looking up directions for nurses to reach their patients home, and also communicating between the 2? This last pay, she received no compensation, and the company claims they are looking into why it wasn't on her paycheck
Your wife needs to speak with an employment attorney who handles wage and hour issues immediately.
