Overpaid for a year

More details to this question:
I was just informed that I was receiving a $1 hr differential for a year. I was in a seasonal roll at my employer where I knew I was getting the $1 differential for the Job function I was in. I was never told when it would stop and now they told me there was a mistake for a the whole year and now they want me to pay the difference back. I didn't think anything of it because I continued to fill in when needed in said function, so I was under the assumption that after the seaonal time ended and the fact I was still doing the function from time to time, that was the reason I was still getting it. I never signed a contract like others who were in the same function and they don't have this problem. What steps can I take against this?

An employer's right to withhold money from an employees wages is quite limited.  Although federal law does not require an employer to obtain the employee's consent to clawback overpayments, there are restrictions on how much can be withheld at any one time.  State law may require written permission.  Best bet is to call a local employment atrorney and have your situation reviewed to get specific advice.
